Terms of Service

Welcome to Playstice. By accessing or using our platform at playstice.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Definitions

"Platform" refers to the Playstice website, web application, and all related services. "User" means any person who accesses the Platform, whether as a listener or artist. "Content" means audio files, artwork, metadata, text, and any other material available on the Platform. "Subscription" means a paid recurring membership granting access to premium features.

2. Eligibility

You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Platform. We reserve the right to terminate accounts that violate this requirement.

3. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your password and for all activity under your account. You must notify us immediately if you suspect unauthorized access.

4. Subscriptions & Payments

Playstice offers a premium auto-renewing subscription. The price, billing interval, currency, and whether VAT or similar taxes are included in the total shown to you will be displayed on the subscription page and again during checkout before you place your order. Subscriptions are billed via Stripe and renew automatically unless cancelled.

You may cancel at any time through the billing portal. If you cancel, your access continues until the end of the current paid billing period, and your subscription will not renew for the next period.

Free-tier users may browse the catalog and listen to 30-second previews. Full-length streaming requires an active subscription.

5. EU Consumer Withdrawal Rights

If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction that grants a cooling-off period for distance contracts, you may have a legal right to withdraw within 14 days after purchase.

However, a Playstice subscription is a digital service that can begin immediately. Where applicable law allows, we will ask you during checkout to expressly request immediate access and acknowledge that your withdrawal right ends once the paid service begins. This does not affect any separate statutory rights you may have if the service is defective or not supplied as agreed.

6. User-Centric Royalty Model

Playstice operates a user-centric royalty model. Each subscriber's monthly payment is allocated proportionally among the artists they personally listened to during that billing period. This means your money goes directly to support the artists you love, not into a general pool.

7. Acceptable Use

You agree not to:

• Use bots, scripts, or automated tools to artificially inflate stream counts
• Share your account credentials with others
• Circumvent any access restrictions or digital rights management
• Upload, distribute, or link to content that infringes intellectual property rights
• Use the Platform for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the Platform
• Interfere with or disrupt the integrity of the Platform or its servers

8. Intellectual Property

All content on Playstice is owned by or licensed to the respective artists and rights holders. You are granted a limited, non-exclusive, non-transferable license to stream content for personal, non-commercial use only. Downloading, reproducing, or redistributing content is strictly prohibited.

9. Termination

We may suspend or terminate your account if you materially breach these Terms, fail to pay fees when due, engage in fraud or payment abuse, infringe intellectual property rights, misuse the Platform in a way that creates security or legal risk, or if we are required to do so by law.

Where the issue can reasonably be corrected, we will normally try to notify you and give you an opportunity to fix it before termination. We may suspend or terminate immediately where necessary to protect users, artists, rights holders, or the Platform.

We may also discontinue the Platform or a material feature on reasonable notice. You may delete your account at any time by contacting us. Upon termination, your right to access subscriber-only features ends immediately, subject to any rights you have under applicable consumer law.

10. Service Availability & Consumer Rights

We work hard to keep Playstice secure and available, but the Platform may occasionally be interrupted, delayed, or unavailable because of maintenance, technical issues, security incidents, or factors outside our reasonable control.

Nothing in these Terms excludes or limits any mandatory rights you may have as a consumer under applicable law, including rights relating to conformity, remedies, refunds, or digital content and digital services.

Except for those non-waivable rights, we do not guarantee that the Platform will be uninterrupted, error-free, or available at all times, and we are not responsible for the legality, accuracy, or quality of content uploaded or provided by artists or other third parties.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Subject to that rule, to the maximum extent permitted by law, Playstice is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from or related to your use of the Platform.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Austria.

If you are a consumer, nothing in these Terms limits any mandatory consumer protections available in your country of residence, and you may bring claims in the courts available to you under applicable law.

If you use the Platform for business purposes, the courts of Vienna, Austria have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
